Since July, Schneider Electric group employees have been able to benefit from a sustainable mobility package when they regularly use carpooling, a bicycle or a scooter to get to work, under an amendment of June 3 to the agreement on quality of life at work. This also includes provisions to encourage the use of electric and plug-in hybrid vehicles, with the group having also committed to electrifying a third of its vehicle fleet by 2025.
Signed by the CFDT, this amendment notably sets up a sustainable mobility package allowing the coverage of transport costs related to employees' home-work journeys, as long as they use certain responsible modes of transport. Applicable to all companies in the group, it will end on June 28, 2022, at the end of the initial agreement.
Implementation of a sustainable mobility package…
The sustainable mobility package (FMD) is accessible in the event of regular use of carpooling (personal or rental vehicle), bicycle (personal or rental) or scooter (rental only). The group also plans measures to encourage the use of electric or rechargeable hybrid vehicles.
Employees without a company vehicle, on permanent or fixed-term contracts, as well as work-study students and interns, are eligible for this, under conditions defined for each mode of transport. Part-time employees benefit from it under the same conditions as full-time employees when their activity rate is greater than 50%, and under adjusted conditions when it is less than or equal to 50%.
…for the development of carpooling…
The allowance allocated under the FMD is intended for employees whether they are drivers or passengers, and is triggered from a threshold set at a minimum of 80 journeys per calendar year (40 for those whose activity rate is less than or equal to 50%). A minimum amount is set at €80 (i.e. €1 per journey), without being able to exceed €200 per year. It is paid in a single payment "in January of year N +1".
Employees must systematically use a platform for connecting drivers and passengers and provide proof before January 15 of year N+1, as well as a sworn statement of the use of carpooling.
…and the use of bicycles or scooters
The use of a personal bicycle or one rented via a shared mobility service (electrically assisted or not), or a scooter (electric or not) from a rental service, also allows you to benefit from the FMD, with the same trigger threshold as the use of carpooling, but with different terms and conditions.
They will thus be able to benefit, once and on request, from an employer contribution of up to €40 for the purchase of a safety kit (certified retroreflective vest, helmet). An additional allowance may also allow for the reimbursement once a year, still up to a limit of €40, of maintenance/repair costs related to the regular use of their bicycle. These two allowances will be paid in one go in January of year N +1.
To benefit from the FMD, employees must provide proof of purchase of safety kit equipment or bicycle maintenance costs, as well as a sworn statement of regular use of cycling or scootering.
Developing electric mobility
The group is committed to providing, at a minimum, the installation of an electric vehicle charging station on all sites by June 28, 2022, provided that the site in question has private parking and the required power supply is available. These stations will be made available to employees free of charge, with appropriate access and time management.
The group also recalls that it offers, through offers to its employees, preferential rates for the purchase of terminals for their installation at home. It undertakes, in this amendment, to continue these practices.
Homogenization of participation in public transport
The amendment also includes the group's commitment to extend the conventional share of its participation in the reimbursement of subscription fees for public transport and public bicycle rental services. Until now disparate across the territory, it will be set at 75% on all sites.
Accumulation of devices
It will be possible to "combine FMD bicycle/scooter allowances and coverage of subscriptions to public bicycle rental/public transport services" for a cumulative amount capped at €500 per year and per employee, exempt from CSG/CRDS social security contributions and income tax.
The combination of FMD bicycle/scooter or carpooling systems and free charging/powering of electric or rechargeable hybrid vehicles will be in the test phase until June 28, 2022.
However, employees who travel both by bike/scooter and by carpooling must opt for one or the other of the arrangements, in order to benefit from the FMD allowance.
Some requests from the CFDT are still not satisfied
Despite this agreement which promotes soft travel, and particularly the use of bicycles, the CFDT is still waiting for the security of bicycle parking to be taken into account. In fact, two thefts have been reported on the Technopole and Intencity sites. Some improvements have been made but remain insufficient.
The employer is considered the custodian of the personal belongings of his employees (clothing, vehicle, mobile phone, etc.). He must therefore implement all useful means to ensure their proper conservation. He is responsible for theft or damage occurring on the company premises. This is a contractual liability, i.e. arising from the employment contract.
For CFDT, the employer must therefore compensate the employee who is the victim of theft or damage.
Since legal texts do not provide for the employer's liability, it is up to the judge to decide in the event of a conflict.
The employee can therefore contact the industrial tribunal.
